Abstract or summary
Në kohë të fundit jemi dëshmitarë të ndryshimeve të shpejta në legjislacionin e procedurës penale pothuajse në të gjitha shtetet e Evropës Perëndimore. Këto ndryshime janë në drejtim të avancimit të mbrojtjes së të drejtave individuale dhe përshpejtimit të procedurës penale, ndryshime këto që nuk kursyen as Evropën Juglindore dhe as shtetin e Kosovës. Karakteristikë e këtyre ndryshimeve është nxjerrja e Kodit të Përkohshëm Penal dhe atij të Procedurës Penale të Kosovës, për herë të parë në vitin 2004 nga Parlamenti i Kosovës, me qellim që sistemi gjyqësor të jetë më funksional në krahasim me atë që ishte sipas LPP të sistemit të kaluar. Me fillimin e zbatimit të KPPK-së, filloj një qasje krejt ndryshe e rolit të organeve të Drejtësisë, Policisë, Prokurorive dhe Gjykatave, meqë u bë një kalim prej sistemit inkuizitor në atë akuzator pasi që i pari u konsiderua i pa dobishëm dhe jo funksional. Në sistemin akuzator, tani në aplikim, kompetencat e hetimeve që më parë i kishte gjyqtari hetues kaluan tek prokurori i shtetit e që një veprim të tillë më herët e kishin ndërmarrë pothuajse gati të gjitha shtetet e Ballkanit. Në mesin e shumë risive të pasqyruara në KPPK, është përcaktimi i pozitës dhe rolit të veçantë të gjyqtarit të procedurës paraprake. Me KPPK, i cili ka hyrë në zbatim nga 1 janari 2013 është avancuar më tutje pozita e gjyqtarit të procedurës paraprake.

| Translated abstract or summary: | We have recently witnessed rapid changes to the criminal procedure legislation in almost all countries of the Western Europe towards promoting individual rights and expediting criminal procedure, changes which also engulfed Southeast Europe and Kosovo. A shared feature of these changes is adoption of the Provisional Criminal Code and Kosovo Criminal Procedure Code, for this first time in 2004 by the Parliament of Kosovo, in order to ensure a more functional judiciary relative to CPL of the previous system. The implementation of the KCPC brought about a new outlook on the role of the justice, police and prosecution bodies with a shift from inquisitorial to accusatory system, as the former was rendered useless and non-functional. Under the accusatory system, currently in effect, the competences over investigations, which had previously been the prerogative of the investigative judge, have now been moved to the state prosecutor, an action similarly adopted in almost all Balkans countries. Among many novelties contained in the KCPC is also the determination of the special position and the role of the pre-trial judge. Under KCPC, which entered into effect on 01 January 2013, the position of the pre-trial judge has been promoted considerably. | ||||||
