Objekt i çështjes është vlerësimi i kushtetutshmërisë se aktgjykimit te kontestuar, i cili pretendohet te ketë shkelur te drejtën e parashtruesit te kërkesës për gjykim te drejte, te garantuar me nenin 31 [E Drejta per Gjykim te Drejte dhe te Paanshëm] te Kushtetutës se Republikës se Kosovës (ne tekstin e mëtejmë: Kushtetuta) si dhe me nenin 6 [E Drejta për një proces te rregullt] (1) te Konventës Evropiane për te Drejta te Njeriut (ne tekstin e mëtejmë: KEDNJ) dhe Konventës kundër torturës dhe trajtimeve a dënimeve tjera mizore, çnjerëzore ose poshtëruese.
