Parashtruesit pretendojnë se me vendimet e gjykatave te rregullta u janë shkelur: neni 21 [Parimet e Përgjithshme], neni 24 [Barazia para Ligjit], neni 31 [E Drejta për Gjykim te Drejte dhe te Paanshëm] dhe neni 32 [E Drejta për Mjete Juridike] te Kushtetutës, si dhe u janë shkelur te drejtat e garantuara me Ligjin e Procedurës Kontestimore dhe me Ligjin e punës. Kërkesa e parashtrueseve ka te beje me kompensimin e pagave te papaguara nga ana e Fabrikës se Konstruksioneve Metalike (ish-UTVA) ne Peje, duke përfshirë periudhën kohore prej 1 qershorit 1995 e deri me 31 mars 1999.
