Abstract or summary
Reforma e sistemit të përmbarimit të vendimeve të gjykatës dhe të dokumenteve tjera të detyrueshme është më e rëndësishmja në kuadër të reformës së drejtësisë. Shteti ynë ka bërë hapa të rëndësishëm në reformimin e sistemeve ligjore dhe gjyqësore si rrjedhojë e procesit të anëtarësimit në BE duke paraparë që legjislacioni, procedurat dhe praktikat të harmonizohen me standardet ndërkombëtarisht të pranueshme, siç janë rekomandimet e Këshillit të Evropës. Raporti i progresit të Komisionit Evropian vëren se sistemet përmbarimore ekzistuese në Kosovë dhe shtetet në rajon nuk përmbushin më kërkesat e së sotmes. Gjykatat kanë numër të madhe të lëndëve të mbetura kryesisht lëndë të përmbarimit. Mundësia e tepërt e përdorimit të mjeteve juridike, shkakton procedura të gjata dhe të panevojshme nëpër gjykata.Duhet të identifikohen disa shkaqe që lidhen me kornizën legjislative, ku ligjet kanë pasur shkallë të lartë të mbrojtjes së debitorit në lëndët e përmbarimit. Performanca dhe standardet e larta të llogaridhënies, vlerësimit dhe performancës janë absolutisht me rëndësi kritike për arritjen e një sistemi të përmirësuar të përmbarimit.

| Translated abstract or summary: | Reform of the system of enforcement of the court decisions, and other obligatory documents is the most important part of the reform of justice. Our state has made significant strides in reforming the legal and judicial systems as a result of EU membership process, by foreseeing that legislation, procedures and practices to be harmonized with internationally accepted standards, such are the recommendations of the Council of Europe. Progress Report of the European Commission notes that the existing enforcement systems in Kosovo and countries in the region do not meet the today’s requirements. Courts have large number of remaining cases, and mainly subject to the execution. The possibility of excessive use of remedies causes lengthy and unnecessary procedures in the courts. There should be identified some causes related to the legislative framework, where laws have had a high degree of protection of the debtor in enforcement cases. Performance and high standards of accountability, assessment and performance are absolutely critical for achieving improved enforcement system. | ||||
