Abstract or summary
The relationship between two parents broke down, there were allegations of violence, and the mother took the child from the US to Croatia. The father introduced return proceedings in Croatia under the Hague Child Abduction Convention. Such proceedings should be completed within six weeks (Art. 11). Instead, at first instance this case took five months. Then came the appeal, which took two-and-a-half months. The case was sent back and the next procedure took one year and nine months. More appeals ensued and all-in-all the proceedings lasted for more than three years, which was more than half of the child’s life: he was just under three years when his mother took him and six by the time of the last national judgment.

Babai inicioi procedurat e kthimit në Kroaci në bazë të Konventës së Hagës rrëmbimit të fëmijëve. Procedurat e tilla duhet të përfundojnë brenda gjashtë javësh (Neni. 11). Në vend të kësaj, në shkallë të parë ky rast mori pesë muaj. Pastaj erdhi ankesa, e cila mori muaj dy muaj e gjysmë. Rasti u kthye dhe procedura tjetër mori një vit e nëntë muaj. Më shumë apele pasuan dhe të gjitha procedurat zgjaten për më shumë se tre vjet, e cila ishte më shumë se gjysma e jetës së fëmijës: ai ishte vetëm nën tre vjet, kur nëna e tij e mori atë dhe gjashtë deri në kohën e gjykimit fundit vendor. |
